Terms of Service.

1. What FormVitals does

FormVitals checks websites for you. Each day it sends a clearly labelled test through a website's form and looks for that test arriving by email. It also checks whether the site loads, its security certificate and domain renewal dates, its email-setup records, and the number of automated accessibility issues. It then alerts you when something changes and sends a monthly report. By using FormVitals you agree to these terms.

2. Permission to test

You may only ask us to test a website you own or manage. If you're an agency, you must have your client's permission for us to submit daily test entries through their forms. Each test is labelled "Automated FormVitals test" and carries a code starting with FV-TEST. You're responsible for filtering these tests out of your records and systems, such as a CRM or job-management tool, if you don't want them there.

3. What we won't do

We never try to get around a CAPTCHA or other bot protection. If a form is protected, we report it rather than test it. We never test a site whose owner hasn't agreed to it. We never describe a site as "compliant" with any accessibility standard, because automated scans only find some issues.

4. What the results mean

Our checks show what we saw at the time we checked. They reduce the chance that a broken form goes unnoticed, but they can't guarantee we'll catch every failure. A form might work for our test and fail for a particular customer, or break between checks. Alerts are sent by email, and by SMS if you set it up, but they can be delayed or not arrive. Please keep your own backup processes for anything critical.

5. Your account

Give us accurate details and keep your login and alert contacts up to date. If you're an agency, you're responsible for the people you add and for the reports you send to your clients under your brand.

6. Fees

Prices are in Australian dollars and are billed monthly in advance. You can cancel any time, effective at the end of the current billing period. We'll give you at least 30 days' notice before a price change affects you. If we become registered for GST, our prices will include it and we'll issue tax invoices.

7. Acceptable use

Don't use FormVitals to test sites you aren't authorised to test, to send spam, to overload websites, or to try to access other customers' data. We may suspend an account that does, and we'll tell you why.

8. Your data

Your website settings and check results belong to you. We use them only to provide the service, as described in our Privacy Policy. If you leave, we delete your data within 90 days, unless the law requires us to keep it.

9. Liability

To the extent the law allows, including the Australian Consumer Law, our total liability for any claim about FormVitals is limited to the fees you paid us in the 12 months before the claim, or to supplying the service again. We aren't liable for lost enquiries, lost sales or other indirect losses. Nothing in these terms excludes rights you have under the Australian Consumer Law that can't be excluded.

10. Changes and ending

We may update these terms, and we'll email you before a significant change takes effect. You can stop using FormVitals at any time. These terms are governed by the laws of Australia.
